Terms of Service

Introduction

These Terms of Service ("Terms") govern your access to and use of the BigStepper Discord bot ("the Bot", "we", "us", or "our"). Please read these Terms carefully before using the Bot.

By using the BigStepper bot, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Bot.

Using Our Bot

Eligibility

You must be at least 13 years old to use the Bot. By using the Bot, you represent and warrant that you meet this requirement.

Discord Terms

Your use of the Bot is also subject to Discord's Terms of Service and Privacy Policy. Nothing in these Terms should be interpreted to override or replace Discord's terms.

Bot Commands

The Bot responds to specific commands prefixed with a slash ("/"). You agree to use these commands as intended and not attempt to misuse or exploit them.

User Content

When you submit step data or other information through the Bot ("User Content"), you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display that User Content in connection with providing the Bot service.

You represent and warrant that your User Content does not violate anyone's rights and complies with these Terms and all applicable laws.

Prohibited Conduct

You agree not to:

• Use the Bot to violate any law or regulation
• Attempt to disrupt or compromise the Bot's functionality
• Use the Bot to spam or harass others
• Access the Bot through unauthorized means

Changes to the Bot

We may modify, suspend, or discontinue the Bot or any part of it at any time, with or without notice. We will not be liable to you or any third party for any such modification, suspension, or discontinuation.

Intellectual Property

The Bot, including all text, graphics, logos, and software, is our property and is protected by copyright, trademark, and other intellectual property laws.

Disclaimer of Warranties

THE BOT IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Bot will always be available, uninterrupted, or error-free.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUE, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

• YOUR USE OR INABILITY TO USE THE BOT
• ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN
• ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE BOT
• ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH THE BOT

Indemnification

You agree to defend, indemnify, and hold harmless us, our affiliates, and our respective officers, directors, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from:

• Your use of the Bot
• Your violation of these Terms
• Your violation of any third-party right, including without limitation any copyright, property, or privacy right

Termination

We may terminate or suspend your access to the Bot without prior notice or liability, for any reason, including if you breach these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of Indiana, without regard to its conflict of law provisions.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.

Entire Agreement

These Terms constitute the entire agreement between you and us regarding the Bot and supersede all prior agreements and understandings.
